MIBT's role as an education provider requires the collection, storage and use of personal information relating to its students, staff and other clients. MIBT recognises its obligation with regard to the collection, storage and use of this information.

MIBT's Privacy Policy has been developed in accordance with the Privacy Act 1988 (Clth) and the National Privacy Principles (NPPs) which apply to private sector organisations.

This policy outlines how MIBT deals with the personal information that it collects. People who deal with MIBT are entitled to expect that any information collected will be treated in accordance with MIBT’s privacy obligations.

The overall responsibility for privacy of information for the College resides with the College Director and Principal, with the day to day management delegated to the Director Quality and Student Administration. The Director Quality and Student Administration is the first point of contact for privacy matters including general information, requests to access and/or amend personal information, and for internal review and resolution of complaints.

Collection of Personal Information

Personal information is defined as any information that would allow an individual to be identified. Personal information can be an opinion, which need not be true, or anything from which the person's identity could be reasonably ascertained.

MIBT collects personal information through a variety of paper and electronic formats in regards to its staff, students and external clients. All information collected is for the purposes of the operations of the College, or where required by law.

The type of personal information which MIBT collects may include an individual's name, phone number, email address, address, nationality, date of birth, and educational history. Due to the nature of the services provided by MIBT, some of the information collected may be sensitive information and include details about an individual's race or ethnic background. It is not common practice for MIBT to collect information about an individual's medical history, religion, political opinion, sexual preference or criminal record, unless such information is required in order to process a student's application for admission, enrolment or employment. MIBT will only collect sensitive information with an individual's consent.

Personal information may be collected by MIBT in the following instances:

  • When an enquiry is lodged through the MIBT online enquiry service;
  • A person applies for admission to MIBT;
  • A person enrols for a course or unit offered by MIBT;
  • A person applies for employment at MIBT.

When a person visits the MIBT website, a record is logged of the visit and the following anonymous information is retained for MIBT’s statistical purposes:

  • The Internet Protocol (IP) address from which the request is received;
  • The date and time that the request is received by the MIBT server;
  • The pages, documents and files requested;
  • The address of the resource which provided the link followed, if any, to the MIBT website;
  • The type of browser and, in some case, the operating system used;
  • In some instances, data sent to its website from web forms (eg. search terms).

Some sections of the MIBT website use standard industry technologies, for example, ‘cookies’. Information collected from the MIBT website is collated for analysis, evaluated and published in reports that show MIBT usage patterns. Popular areas of the website are identified in order to improve and develop the website and its services. MIBT also uses software programs to monitor network traffic and to identify unauthorised attempts to upload or change information, or otherwise cause damage.

Use of Personal Information

MIBT collects personal information for the primary purpose of providing its services to individuals. Personal information may be collected for purposes related, or ancillary to, the primary purpose of collection. This includes:

  • Administering and managing the services provided by MIBT to prospective and current students, including admission, enrolment, education, billing, maintaining information technology systems, customer service and data storage;
  • Marketing the services of MIBT and its related entities to prospective, current and past students;
  • Hiring and managing employees and contractors;
  • Planning, monitoring, evaluating and improving its services, including conducting market research and surveys and assessing customer satisfaction; and
  • Communicating with individuals.

MIBT will only use and disclose personal information about a person for the purposes provided in this policy, where consent is given to MIBT to do so, or as otherwise required or authorised by law.

MIBT may need to share student information with partner institutions in the course of providing education classes on the institution's campuses.

By providing personal information to MIBT, a person consents to MIBT using information to contact that person by mail, email, SMS or telephone on an ongoing basis in order to provide that person with marketing information which MIBT considers may be of interest to that person.

MIBT may engage other companies and contractors to provide services on its behalf, including entities located outside Australia. To perform their obligations, these entities may need to access personal information retained by MIBT.

MIBT may also use a cloud-based service to store and process personal information. By providing personal information to MIBT, a person consents to MIBT disclosing their personal information to entities located outside Australia, on the basis that MIBT is not required to ensure that any overseas recipient complies with Australian privacy laws.

MIBT generally collects personal information directly from a person concerned. However, there may be occasions when information is collected from third parties who contact MIBT on that person's behalf, from MIBT’s contractors who supply it with services, through its partner institutions or from a publicly maintained record. If a person does not provide the information requested by MIBT, MIBT may not be able to provide that person with its services.

If personal information is provided to MIBT about a third party, the person providing this information must ensure that they are entitled to disclose that information to MIBT and that, without MIBT taking any further steps required by privacy laws, MIBT may collect, use and disclose such information for the purposes described in this Policy. Moreover, reasonable steps should be taken to ensure the individual concerned is aware of matters detailed in this policy, including MIBT’s identity, how to contact MIBT, the purposes for which MIBT collects personal information, MIBT’s information disclosure practices, the third person’s right to obtain access to the information held about them and the consequences for that person if the information is not provided. The third person must also consent to MIBT's handling of their personal information.

Disclosure of Personal Information

Information will be disclosed to Deakin University in the transfer of academic results or information on students to determine eligibility for transfer into the second year bachelor degree.

Information about a person may also be disclosed where:

  • There is a serious and imminent threat of life, health or safety;
  • There is a requirement under law, or authorised by law;
  • There is a requirement under an enforcement body; and
  • Statutory requirements must be met for collection and disclosure of personal information.

MIBT is required to collect and disclose information during a student's admission and enrolment in order to meet its obligations under a range of legislative requirements. Examples of the disclosure of information include:

  • Department of Education, Employment and Workplace Relations (DEEWR) - statistical information about student enrolment, educational background country of birth, or where a student has requested financial assistance with tuition fees;
  • Australian Taxation Office (ATO) - in relation to FEE-HELP where a person may defer fee payment through the taxation system;
  • Department of Industry, Innovation, Science, Research and Tertiary Education and Workplace Relations (DIISRTE) under the obligations of the Education Services for Overseas Students (ESOS) Act 2000;
  • Department of Immigration and Citizenship (DIAC) - reporting requirements in respect of matters relating to students on overseas student visas under the Migration Act 1958 and the Migration Regulations 1994;
  • Centrelink - enrolment information on domestic students accessing Centrelink benefits;
  • Worldcare Assist - where overseas students purchase Overseas Student Health Cover (OSHC) through MIBT;
  • Tuition Protection Scheme - tuition assurance for overseas students.

MIBT will not disclose or externally publish personal information to third parties who are not related to MIBT to allow them to direct market their products or services without the relevant person's consent.

No attempt will be made to identify individual users on the MIBT website or their browsing activities, except in the likely event of an investigation or legal proceedings, or where otherwise permitted to do so under the Privacy Act 1988.

Access to Personal Information

An individual can obtain a copy of their personal information held by MIBT by contacting the Director Quality and Student Administration through (mibt@deakin.edu.au). An individual can also contact the Director Quality and Student Administration for amendments to their personal information held by MIBT.

Students may review and amend the personal information held by MIBT through the student portal.

Storage and Security of Personal Information

MIBT has security measures in place to protect against loss, unauthorised access, misuse, modification or disclosure of information under its control, as required by law and generally accepted industry standards. However, no system is absolutely secure and to the extent permitted by law, MIBT excludes any liability in contract, tort or otherwise for any security breach.

All reasonable steps are taken to destroy hard copies of personal information that are obsolete or no longer required by MIBT. Destruction of personal information is undertaken by secured means.

Publishing Personal Information on the MIBT Website

MIBT will only publish personal information on its website if that information has been collected for this purpose, with the knowledge and consent of the individual.

When giving such consent an individual should be aware that information published on MIBT’s website is accessible to millions of users from all over the world, that it will be indexed by search engines and that it may be copied and used by any web user. This means that once the information is published on our website, MIBT will have no control over its subsequent use and disclosure.

Names and email addresses of MIBT staff appearing on the website are provided with their knowledge and consent.

Under no circumstances will MIBT sell or receive payment for licensing or disclosing personal information.

Where there are links to other sites, MIBT is not responsible for the privacy practices or the content of those websites.

Grievance and Review Procedures

If an individual believes that their personal information has not been dealt with in accordance with this policy or a NPP, they may lodge a grievance in accordance with the Grievance Procedures Relating to Non-Academic Matters.

The grievance should be lodged with the Director Quality and Student Administration in the first instance for resolution through mibt@deakin.edu.au.
